This is an application for condonation of delay of two years and four months in filing the application for leave to file appeal. The report submitted by the registry indicates that the respondent No.2 has been served. Despite service, none appears for respondent No.2.

For the reasons stated in the application, I am inclined to condone the delay subject to payment of costs of Rs.20,000/- to be paid to the High Court Legal Aid Services Committee. The payment of costs is the condition precedent for condonation of delay. Costs to be paid within a period of 2-weeks from today. 3.

In view of the above, application is allowed in terms of prayer clause (a) subject to payment of costs of Rs.20,000/-to be paid within a period of two weeks from today. (A.S.GADKARI, J.)
