After arguing for some time, when I expressed my disinclination to grant relief in this Application, Ms. Sana Raees Khan, learned counsel for the Applicant prays for unconditional withdrawal of this application. She only made one request that considering that the Applicant No.1 is 80 years of age and a lady and the Applicant No.5 is also a lady, their case may be considered on humanitarian grounds. 2.

Learned APP and learned counsel for the Intervenor do not have objection for granting anticipatory bail to these two ladies. Therefore, 1/3

the Anticipatory Bail Application No.1449/2021 as regards Applicant No.2 - Prakash Vishnu Barate, Applicant No.3 - Manohar Laxmi Barate, Applicant No.4 - Rajendra Laxmi Barate and Applicant No.6 - Alok Manohar Barate is allowed to be withdrawn unconditionally and is disposed of as such.

As far as Applicant No.1 - Bhagirathi Vishnu Barate and Applicant No.5 - Neela Manohar Barate is concerned, they can be protected by an order of Anticipatory Bail as the investigating agency does not have objection. Hence, the following order :-

O R D E R

(a) In the event of their arrest in connection with C.R.No.261/2021 dated 17/05/2021 registered at Yerwada Police Station, Pune, the Applicant No.1 - Bhagirathi Vishnu Barate and Applicant No.5 - Neela Manohar Barate are directed to be released on bail on their furnishing P. R. bonds in the sum of Rs.30,000/- each (Rupees Thirty Thousand Only) with one or two sureties each in the like amount.

(b) The Applicant Nos.1 and 5 shall attend the concerned 2/3

Police Station as and when called and shall cooperate with the investigation.

(c) Application stands disposed of accordingly. (d) I have heard the learned counsel for the Intervenor. With the disposal of the Anticipatory Bail Application, Interim Application does not survive and stands disposed of accordingly.
