Heard. This Application is made by the Insurance Company for transfer of sum of Rs.25,000/- deposited by them in the Registry at the time of filing the first appeal to Motor Accidents Claims Tribunal, Thane.

Considering the submissions made by the learned counsel for the applicant and the averments made in the civil application, I am of the opinion that the applicant has made out a case for allowing the civil application.

Hence, following order is passed:

a.

Civil Application is allowed in terms of prayer clause (a) which reads thus:

(a) Rs.25,000/- deposited in High Court at the time of filing of application u/s. 173 of the Motor Vehicles Act, 1988 in the Basavraj G Patil 1/2

14.3917.15-caf aforesaid first appeal may be transferred to the lower court along with interest accrued thereon till date in MACT No.937/2008 at Thane.

(b) Civil application stands disposed off accordingly.
