Rule. By consent of the parties, Rule made returnable forthwith and heard finally at the stage of admission. 2.
In this petition, a limited prayer is made that the petitioner has made an application alongwith documents for including his name in Annexure II in the redevelopment process of the building as he claims one tenament on the basis that he was occupying the tenament prior to 1995 in the building which is under redevelopment.

The learned Counsel for the petitioner makes a statement that the application alongwith documents is submitted and he has
wp.13895.2016_2.doc been heard by the respondent No.3 - Executive Engineer, D2 Division, M.B.R. & R. Board, Mumbai on 2.2.2013 and till today, the said authority i.e., respondent No.3 has not given a decision on his application.

Considering the prayer in the Writ Petition, no notices are required to be issued to the respondents. The Respondent No.3 - Executive Engineer, D2 Division, M.B.R. & R. Board, Mumbai, is hereby directed to hear and decide the application of the petitioner on its merits, within a week from today. It is made clear that no stay is granted in this matter.

Rule made absolute in terms of prayer clause 18(b). Writ Petition is disposed of accordingly.

Learned Counsel for the petitioner as also the learned AGP appearing for the State to communicate this order to Respondent No.3, Executive Engineer, D2 Division, M.B.R. & R. Board, Mumbai.
