Vide order dated 1st July 2022 it was recorded that NOC for admission of the child to the school would be provided by the Respondent No.1 to the Petitioner with a rider that providing NOC may not be construed as consent for payment of school fees. Learned counsel for Petitioner submitted that the Respondent No.1 has complied the order and handed over the NOC for admission of the child in the school and that the Petitioner has submitted the said NOC to the school.

Learned counsel for Petitioner further submitted that the application for interim maintenance preferred by the Petitioner is pending before the Court of learned Magistrate since long and by SAJAKALI LIYAKAT JAMADAR Date:

Learned counsel for Respondent No.1 submits that even Respondent No.1 had preferred an application under Section 340 of Cr.P.C. which is also required to be disposed off. The Petitioner sought adjournment before trial Court on the last two dates of hearing.

In view of the fact that the NOC has been handed over to the Petitioner with regards to the admission of the child in the school, this Petition can be disposed of. It is clarified that this Court had not considered the issue of payment of school feels. The trial Court is directed to request to decide the applications preferred by either party expeditiously.

Criminal Writ Petition No.1913 of 2022 stands disposed of accordingly.
