The learned APP, on instructions from the investigating officer, state that FIR disclose that the interest on the amount of Rs. 27,20,000/- which was advanced to applicant is not repaid as against the gold ornaments of 679.8 gm which was pledged with the complainant. She further state that the said gold ornament is found to be the stolen property in respect of another crime in which the applicant was arrested and he confessed that it is a stolen property.

2/3 24 ABA 1367.22.doc The applicant faces accusations in CR No.87 of 2021 for the offences punishable under sections 342, 364, 384 read with 120 B of IPC. The Officer of DCB, CID Unit-X has already seized the entire Jewellery. In the wake of the above, in order to deal with the accusations that the interest was not paid, the custodial interrogation of the applicant is not necessary. Hence the following Order.

ORDER

(a) In the event of arrest, the Applicant Anil Bansilal Choudhary @ Akash Choudhary shall be released on bail in C.R. No. 1098 of 2021 registered with Goregaon Police Station, District Mumbai on executing P.R. bond to the extent of Rs.25,000/- each and furnishing one or two sureties of the like amount.

(b) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case and shall not tamper with prosecution evidence.

(c) The Applicant shall report to the police station as and when directed by the Investigating Officer. 3.

The application is disposed off in the aforesaid terms.
