The learned Counsel for the Petitioner seeks permission to withdraw the Petition with liberty to prefer a revision before the statutory authority under Maharashtra Land Revenue Code, 1966.

The Writ Petition stands disposed of with liberty to prefer the Revision Petition against the Order passed by the Divisional Commissioner on 11.08.2016.

Since the Petitioner herein was not a party to the proceedings bearing Revision No.432/2014, the statutory authority may give an opportunity of hearing to the Petitioner before passing any adverse order on the tenability of the Revision Petition, which the Petitioner proposes to file. 4.

The ad-interim order passed by this Court on 20.06.2017, whereby the interim protection granted by the Respondent No. 2 in Review Application No.30/2016, on 21.12.2016, was continued, shall remain in operation for a period of eight weeks from today.

It is made clear that this Court has not examined the matter on merits and all the contentions of all the parties are kept open for consideration.
