Heard the learned counsel appearing for the respective parties. Admittedly the Petitioner herein has filed an Appeal challenging the order dated 18/04/2019 passed by Respondent No.3 i.e. The Commissioner for Cooperation & Registrar Co-operative Societies, Pune under Section 152 of the Maharashtra Cooperative Societies Act, 1960 before Respondent No.2 i.e. The Hon'ble Cabinet Minister for Co-operation, Marketing and Textile. The learned AGP Mr. S D Rayrikar appearing for the Respondents/State, on instructions, submits that Respondent No.2 is ready to dispose of the Appeal filed by the Petitioner within one month from today. He has tendered across the bar the copy of the letter written by the Deputy lgc
(907) wp-5481.19.doc Secretary and Assistant Registrar, Cooperative Societies, addressed to him. The same is taken on record and marked as "X" for identification. In the light of the statement made by the learned AGP that the Appeal filed by the Petitioner will be decided by Respondent No.2 within one month from today, it would be for the Petitioner to agitate his grievance raised in this Petition before Respondent No.2. However, the impugned order shall not be acted upon by the Respondents, till the Appeal is decided by Respondent No.2, and thereafter for a period of 10 days from the date of passing of the order by Respondent No.2 in the said Appeal, if the order goes adverse to the Petitioner. Needless to observe that this Court has not expressed any opinion on merits of the matter and it is for the parties to take all possible contentions available to them on merits before Respondent No.2. With the observations as afore-stated, the Writ Petition stands disposed of.
