By this petition under Article 227 of the Constitution of India the Petitioner challenges the order dated 23.03.2016 passed by the learned District Judge 2, Solapur rejecting their Application below Exhibit- 39 in civil appeal No.279/2008 under order 1 rule 10 of the Code of Civil Procedure, 1908 for joining them as party.

The learned counsel for the Petitioner submits that identical issue was involved in Writ Petition No.7875/2016 which came to be dismissed by this court by order dated 26.02.2019. Considering the submissions made by the learned counsel for the Petitioner and for the reasons stated in order dated Basavraj G. Patil 1/2
