17 AUGUST 2022 P.C. :- By this Petition, the Petitioner has sought to quash the FIR lodged by the Respondent-Complainant and also a look out circular.

When the Petition came up on board on 11 October 2021, it was pointed out by the Complainant that in the Petition, the Petitioner has stated in paragraph 7 that the Petitioner has not filed any Petition in this Court or the Supreme Court and the Petition for transfer of investigation was not entertained and dismissed by the Supreme Court.

According to the Complainant, this prayer for quashing the FIR was made before the Hon'ble Supreme Court and was not entertained. Thereafter, the learned counsel for the Petitioner has sought time to apply to the Hon'ble Supreme Court for clarification. We are informed that the application made by the Petitioner was rejected.

Today, the learned Counsel for the Petitioner states that the Petitioner has given instructions to simplicitor withdraw the Writ Petition. In light thereof, the challenge raised in this Petition and prayers made are deemed to have not been pressed by the Petitioner and are dismissed.

We had dictated in the Court and also put to the learned Counsel for the Petitioner the implication of withdrawal of the Petition, and the learned Counsel for the Petitioner reiterated the request for withdrawal.
