The matter was looked into first half and it became clear that affidavit of respondent No.1 complainant stated to be filed on 20/8/2019 was not available in Court file.

Learned counsel for Respondent No.2 therefore has prepared another affidavit in original stating that it is replica of earlier affidavit and tendered it. The printout from website of this Court showing filing of said affidavit on 20/8/2019 is also produced.

Petitioner is present with his advocate and respondent No.1 is also present with her advocate. Matrimonial dispute is already settled between them and Consent Terms have been presented in Petition No. A392/2014 on 13/8/2018. That proceeding has now been converted into proceedings for grant of decree of divorce by mutual consent.

Respondent No.1 is reiterating her request before the Court and gives no objection.

In view of this development and joint request, we make the Rule absolute in terms of prayer clause (a).
