Mr. J.P. Yagnik APP, for the Respondent-State. CORAM : A. S. GADKARI AND SHYAM C. CHANDAK, JJ.
DATE : 6th MAY, 2024.
P.C.:- 1) This is an Application for condonation of delay of 3 years, 11 months and 14 days in preferring substantive Appeal against the conviction. 2) Record indicates that, since the date of his arrest the Applicant is behind bars and therefore after pronouncement of impugned Judgment and Order, he could not immediately prefer an Appeal against conviction for want of legal and financial assistance. He thereafter approached the Legal Aid Committee and thereafter an Advocate was appointed to espouse his cause and represent him. The present Advocate thereafter filed this Appeal. In the said process, the said delay has occurred. 3) In view thereof and for the reasons stated in the Application, delay is condoned and Application is allowed in terms of prayer clause (a).
