The Learned Counsel for the Petitioner seeks withdrawal of the Petition in view of the letter dated 15.06.2015 addressed by the Chairman of the Petitioner to Mr. P. S. Dani the Learned Counsel who was appearing for the Petitioner. In the said letter the settlement which was arrived at between the Petitioner and Shri. Dattatraya Keshav Kulkarni i.e. the Respondent No.1 has been referred to, pursuant to which settlement, it is stated that Shri. Dattatraya Keshav Kulkarni has paid the amount of Rs.46,185.75 to the Petitioner society and the Petitioner society has thereafter handed over possession of the plot of land in question. The above Petition is accordingly allowed to be withdrawn and dismissed as BGP.

In view of the settlement, the amount of Rs.51,000/- which has been deposited by the Petitioner in this Court pursuant to the order dated 28.08.2009 is allowed to be withdrawn by the Petitioner.
