Heard the learned Counsel appearing for the applicant/appellant. He invites our attention to the averments made in the Application. He submits that plausible explanation has been given in support of his prayer for condonation of delay in filing the Appeal.

Learned APP appearing for the Respondent - State submits that he has no objection if the delay in filing the Appeal is condoned.

In the light of the averments made in the application and grounds taken therein, the delay in fling the appeal is condoned. The application is allowed and stands disposed off accordingly. 4.

Appeal is admitted. On admission, learned APP waives service of notice on behalf of the Respondent - State. 6.

Since the appellant is in jail from 2014, the Registry is directed to expedite the process of preparation of paperbook. On receiving the paperbook, liberty to mention the appeal for final hearing.
