Heard learned counsel for the parties.
By this application, the applicant seeks his enlargement on bail in connection with C.R. No. 479 of 2018 registered with the MIDC Police Station, for the alleged offences punishable under Sections 489B and 489C r/w 34 of the Indian Penal Code.
According to the prosecution, on 12th October 2018, a trap was laid, pursuant to the secret information received that certain persons were carrying counterfeit currency notes; the applicant was apprehended on the spot and 30 currency notes of Rs. 2,000/- totalling Rs. 60,000/- were found SQ Pathan 1/2
ba.1346.19.6.doc from the possession of the applicant; another person along with the applicant was also found in possession of the counterfeit notes. Pursuant thereto, the aforesaid complaint was registered. Considering the aforesaid, this is not a fit case to enlarge the applicant on bail. Accordingly, the application is rejected. It is made clear that the observations made herein are prima facie, and the trial Court shall decide the case on its own merits, in accordance with law, uninfluenced by the observations made in this order.
