Heard learned Counsel for the applicant and learned APP for State.

Apprehending arrest in Crime No. 37/2022 registered with State Excise Department, Divisional Flying Squad, Chandwad Police Station, Nashik for the offences punishable under Section 328 of the Indian Penal Code and Sections

2/3 65(a), (b), (c), (d), (e), (f), 80, 81, 83, 90 and 103 of the Bombay Prohibition Act, applicant seeks pre-arrest bail. 3.

The only allegation against the applicant is that, he was supplying raw-material to the co-accused for manufacturing the spurious liquor which was allegedly seized by the Flying Squad of the State Excise Department. 4.

Pending application, the Sessions Court had granted interim protection to the applicant. Eventually, that protection was extended by this Court, vide order dated 15 th June, 2022 subject to condition that, he shall attend Chandwad Police Station on every Sunday between 10.00 a.m. to 12.00 noon.

Learned Prosecutor submits that chargesheet against co-accused has been filed and sofar as the present applicant is concerned, the Investigating Officer has verified the bank details, which confirms that he had some transactions with the co-accused. Learned APP, on instructions submits that, there are no criminal antecedents against the applicant.

In consideration of the facts of the case, custodial interrogation of the applicant may not further the

3/3 prosecution's case. For all these reasons, the application is allowed. Thus, the following order :

O R D E R

(i) In the event of arrest of the applicant in Crime No. 37/2022 registered with State Excise Department, Divisional Flying Squad, Chandwad Police Station, Nashik he be released on bail on executing P.R. Bond in the sum of Rs. 30,000/- (Rs. Thirty Thousand only) with one or more local sureties in the like amount;

(ii) Applicant shall report to the concerned Police Station, once in a month i.e. second Monday of each month, commencing from 14 th November, 2022 between 11:00 to 1.00 p.m.

(iii) Applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case. 7.
