DATED : 24th MAY, 2022 (Vacation Court) P.C:- The applicant has placed on record the medical papers of the Bombay Hospital when his father was admitted on 9/4/2022 and came to be discharged on 25/4/2022. The said medical papers referred to a next Chemotherapy (third cycle) on 29/5/2022 and advise several tests to be conducted on 27/5/2022. The discharge summary further direct a follow up with Dr.Rajesh Shinde in the OPD with prior appointment on 28/5/2022.

On perusal of various orders passed by the Sessions Court as well as this Court, the applicant has been shown sufficient sympathy in order to cater to the sufferings and Tilak

2/2 45 BA 1662-22.doc ailments of his father although he is accused of a serious offence under MCOCA.

In it's order dated 14/3/2022, this Court had specifically noted that the applicant shall make some alternate arrangements of a caretaker who can take care of his father and the period of surrender was extended till 1/4/2022. The applicant again comes up with a difficulty that there is nobody to cater to the needs of his father and particularly, now when he is expected to undergo a chemotherapy cycle on 29/5/2022. In the aforesaid circumstances, the learned counsel for the applicant seek one month's time to surrender. However, her attention is invited to the order dated 14/3/2022 when this Court had already directed the applicant to make adequate arrangements to cater to his father. Since the learned counsel accepted that, the applicant shall surrender on or before 10/6/2022, the request is acceded to, and the time to surrender stands extended upto 10/6/2022.

It is made clear that if the applicant do not abide by the aforesaid order, the appropriate authorities to ensure his confinement in prison, awaiting the trial.

Application is disposed off.
