This is an application under Section 438 of Code of Criminal Procedure for anticipatory bail.

The applicant is apprehending his arrest in Crime No. 64 of 2023 registered at Shivajinagar Police Station, Pune for the ofences punishable under Sections 420 and 408 of the Indian Penal Code.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. 4.

The applicant was working with the complainant, who is in real estate business. It is alleged that the applicant misappropriated the amount of Rs.3,80,000/- which were given to him to collect documents from various government ofces in relation to land which the complainant wanted to purchase in Solapur district.

According to the applicant, the land in question was occupant class-II land and thus several permissions were required including payment of Nazrana. According to him, he had utilised the amount in question for obtaining permissions. 6.

Prima facie, the dispute between the parties appears to be of purely civil nature. I am therefore, inclined to release the applicant on anticipatory bail. In the result the following order is passed.

ORDER

A) The Application is allowed.

B) In the event of arrest of the applicant in C.R. No.64 of 2023 registered at Shivajinagar Police Station, Pune for the ofences punishable under Sections 420 and 408 of the Indian Penal Code, he be released on bail on executing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount. C) The applicant shall attend the concerned police station as and when called by the Investigating Ofcer and shall cooperate in the investigation.
