Heard. The Applicant herein is arrested on 4.12.2009 in C.R. No. 422 of 2009 registered at Sahakar Nagar Police Station, Pune for the offence punishable under section 397 and 118 of the Criminal Procedure Code. The Accused was enlarged on bail on 4.1.2010. It appears that he had furnished he surety on 22nd August, 2013. Thereafter, on 13th June, 2015 he was again arrested in Crime No. 197 of 2015 registered with Bharti Vidyapeeth Police Station and he was released on bail on 2nd May, 2017 by the High Court. After the provisions of MCOC Act were invoked in Sessions Case No. 274 of 2010, V.A. Tikam 1/2
non-bailable warrant was issued against the present Applicant and he appeared before the Court on 4.11.2017. The Applicant had then filed an application seeking enlargement on bail which was rejected on 27th February, 2018. 2.
It appears that the Applicant is an habitual offender. There are several cases registered against him. Moreover, the Applicant was absconding in Sessions Case No. 274 of 2019 for a suitable period and, hence, the order passed by the Sessions Court cannot be faulted or interfered. However, the Learned Sessions Court seized with the Sessions Case No. 274 of 2010 is requested to make an endeavor to conclude the recording of evidence on or before 30th October, 2019. The present application stands rejected and disposed of.
