By this Petition under Article 227 of the Constitution of India, the petitioners, hereinafter referred to as 'defendants No.2 & 3' have challenged the judgment and order dated 30.4.2011 passed by the learned Judge, City Civil Court, Greater Bombay in S.C. Suit No.1951/2010. By that order, the learned trial Judge held that the City Civil Court has pecuniary jurisdiction to entertain and try the suit.

Mr.Oberoi seeks permission to withdraw the Petition. He further submits that interim

On the motion made by Mr.Oberoi, Petition is allowed to be withdrawn and is disposed of as such. Interim order granted earlier shall stand vacated. Mr.Oberoi assures that he will serve copy of this order on the other side. Order accordingly.
