1] The grievance of the Petitioner was to the management of the 5th Respondent school not offering him appointment as an Assistant Teacher on compassionate basis notwithstanding he being entitled to the same on the death of his father on 26th September 2007; who was an Assistant Teacher.

2] During the pendency of the Petition the Petitioner has been appointed as a Junior Clerk by the Respondent No.5 school and thus the relief prayed for in the Petition need not be granted in view of the afore-noted fact. However, we note that the communication sent by Respondent No.5 to the Respondent No.3 to accord approval is pending consideration before the Respondent No.3. BGP. 1 of 2

3] Thus, while disposing of the Petition as infructuous, we direct the Respondent No.3 to pass necessary orders on the proposal received by Respondent No.3 from Respondent No.5 concerning Petitioner's appointment as a Junior Clerk. Necessary decision would be taken within 12 weeks from today.
