DATE: 8th MAY, 2024 P.C.:- Challenge raised in this writ petition is to the show cause notice dated 05/04/2024 issued by Respondent No.1 calling upon the Petitioner to deposit the amount of Rs 29,78,146/- under Section 8-E of the Employees' Provident Fund & Miscellaneous Provisions Act, 1952. It is seen that against issuance of Recovery Certificate dated 04/05/2023, the Petitioner has filed an appeal under Section 7-I of the said Act and the same is pending. Since the appeal is pending, it is open for the Petitioner to obtain appropriate orders therein. In that view of the matter, we are not inclined to entertain the writ petition.
