1) This is an application for temporary bail on the ground that the marriage of the sister of the applicant, scheduled on 22.5.2016 at Khed, District Pune. 2) The applicant is convicted under section 376 (2)(g), 506 read with section 34 of the IPC and has been sentenced to suffer rigorous imprisonment for ten years. 3) The learned APP, on instructions, expressed apprehension that if the applicant is released on temporary bail, there is every possibility that the applicant may take revenge against the minor victim and/or threaten the witnesses. In view of the above, this Court gave suggestion to the learned counsel for the applicant that the applicant will be permitted to attend the marriage of his sister in police escort to which the learned counsel after taking instructions from the relatives of his client who are present in the Court flatly denied. He submitted that if the applicant is to be released on
2 /2 914-appa-648-16.doc temporary bail he should be released without any condition. 4) In view of the apprehension expressed by the learned APP, I find that the appellant cannot be released on temporary bail without police escort. 5) The application is accordingly dismissed.
