By this civil application, applicant/Insurance Company is seeking condonation of 92 days delay in filing first appeal, challenging order dated 22.8.2014 passed by M.A.C.T., Thane, below Exh.5 i.e. application u/s 140 in M.A.C.P. no.643/2012 directing applicant to pay sum of Rs.50,000/- with interest @ 7% p.a. to the respondent. 3.
Learned counsel for applicant submits during the pendency of present first appeal, M.A.C.P. No.643/2012 itself decided finally on its own merits. Hence, nothing survives in the proceeding.
