This is an application for leave to file appeal, preferred by the State challenging the acquittal of the respondent in the matter of offences punishable under Sections 323, 324 read with Section 34 of IPC. In view of provisions of Section 378(1)(a) of Cr.P.C., the present appeal is required to be taken before the concerned Sessions Court as challenge is to the order of Additional Chief Metropolitan Magistrate, Ballard Pier, Mumbai and one of the sections under which the respondent is acquitted is Section 324 of IPC which is cognizable and non-bailable. As such, present matter is disposed of with liberty to the State to take appropriate course of action as provided under Section 378(1)(a) of Cr.P.C..
