By this Petition the Petitioner has impugned the order dated 22 November 2001 passed by the Respondent No.3 Education Officer (Secondary), Zilla Parishad, Solapur, directing the Respondent No.4Management to appoint the Respondent No.5- Dilip Mahadeorao Thorat as Head Master.

While admitting the Petition, the Court had stayed the impugned order dated 22 November 2001 of the Respondent No.3-Education Officer pending the hearing and final disposal of the Petition. Uday.P.Kambli 1/2

For the reasons recorded in the judgment and order passed today in Writ Petition No.1624 of 1998 (Shri. Dilip Mahadeo Thorat Vs. The Secretary Shikshan Prasarak Sanstha), this Petition deserves to be allowed. It is accordingly allowed. Rule is made absolute in terms of prayer clause (a) which read as follows:

(a) Issue appropriate writ, order or direction, quashing and setting aside the order dated 22-11-2001 passed by the Respondent No.3-Education Officer (Secondary), Zilla Parishad, Solapur. 4.

There shall be no order as to costs.
