The petitioner-complainant submits that police ought to have investigated the complaint properly. The FIR is registered under Section 324 of the IPC. The petitioner states that FIR ought to have been registered under Section 307 of IPC. Injury certificate shows that petitioner suffered contused lacerated wound on the back. Learned APP, on instructions from PSI Swapnil Thakre, attached to Khar Police Station, Mumbai, submits that within two weeks final report would be submitted.
2/2 31-wp-1820-16 Without expressing any opinion on the statement made by the learned APP, petition is disposed of. In case the petitioner still feels aggrieved on filing of final report, he may resort to appropriate alternate remedy as prescribed under law.
