Heard learned counsel for the parties.

By these Applications, the Applicants seek pre-arrest bail in connection with C.R.No.561 of 2016 registered with the Hinjewadi Police Station, Pune, for the alleged offences punishable under Sections 406, 420 r/w.34 of the Indian Penal Code.

Learned counsel for the Applicants submits that the Complainant himself was an independent representative like the aforesaid Applicants. He submitted that no offence as alleged is disclosed qua any of the Applicants. He further submitted that the Applicant Vikram Singla had given his credit card to be used to the Complainant, pursuant to which, certain purchases were made, however, the said amounts were returned back by the Complainant to the Applicant - Vikram Singla and the same is reflected in the bank statements. He further submitted that about 20 similar C.Rs. have been stayed by the Apex Court. 4.
Learned APP states that pursuant to the Order dated 7.06.2017, the Applicants have attended the concerned police station and have also handed over necessary documents. She states that custodial interrogation of the Applicants is not required.

Considering the aforesaid and the nature of allegations qua the Applicants, the Applications are allowed and the Applicants are granted pre-arrest bail on the following terms & conditions:-
O R D E R (i) In the event of arrest, the Applicants be enlarged on bail, on executing PR Bond in the sum of Rs.15,000/- each with one or two sureties in the like amount;
(ii) The Applicants shall report to the investigating officer as & when called for by the investigating officer; (iii) The Applicants shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The Applications are allowed in the aforesaid terms and are accordingly disposed of.

It is made clear that the observations made herein are prima facie, and the trial Court shall decide the case on its own merits, in accordance with law, uninfluenced by the observations made in this order.
