Learned APP on instruction submits that a chargesheet has been filed against the applicant during the pendency of this application. The application preferred by the applicant was rejected by the Sessions Court on the ground that the investigation was in progress and the chargesheet is yet to be filed. 2.

In view of the above, learned advocate for the applicant seeks permission to withdraw this application with liberty to prefer a fresh application before the Sessions Court.
