This is an application for suspension of sentence and releasing the applicant on bail during pendency of the appeal filed by him. The applicant has been convicted of offence punishable under Section 7 as well as under Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988. He has been sentenced to suffer rigorous imprisonment for one year as well as that of two years respectively on both these counts. Heard the learned Advocate appearing for the applicant/accused. He argued that the substantive sentence of Gaikwad RD 1/2
(903)APPANo.7492018 imprisonment imposed on the applicant has already been suspended by the learned trial Court and the applicant has already deposited the fine amount.
The learned Additional Public Prosecutor opposed the application.
Considering the fact that the substantive sentence of imprisonment imposed on the applicant has already been suspended by the learned trial Court and as the applicant has already deposited the fine amount, I see no reason to refuse the relief as prayed. Hence, the Order.
ORDER
i) The application is allowed.
ii) The substantive sentence of imprisonment imposed on the applicant is suspended and he is directed to be released on bail on executing P. R. Bond of Rs.15,000/- and on furnishing surety in the like amount.
