The judgment dated 27th October 2014 is one that simply directs the Appellant to reconsider the whole issue. This is no judgment at all. It was for the ESI Court at Pune to finally dispose of the matter and not remand it on this basis for a fresh order under Section 45A of the Act.

Parties are agreed that the order may be set aside and remanded to the ESI Court at Pune for a final decision. In addition, parties are agreed that before that both sides may produce such additional material as they think fit.
