Ms. Shinde, learned APP, on instructions from Police Inspector (Crime Branch) Borivali Police Station, Mumbai submitted that, the trial of Petitioner i.e. Sessions Case No.161 of 2017 arising out of C.R. No. 174 of 2012 registered with Borivali Police Station, Mumbai has substantially progressed and the last witness i.e. Doctor, who conducted autopsy on the dead body of Nitin Dhakan is in the witness box. That, the examination-inchief of the said witness is completed. 2.

In view of above, the grievance of Petitioner that, the charge in his case is not framed has no substances in it. The prayer of Petitioner for Writ of Habeas Corpus, according to us is misconceived. 3.

Petition is accordingly disposed off.
