Advocate Mr. Sarda submitted that, subsequent to filing of the present Petition by the Petitioner from jail, he has received instructions to appear in the matter and has filed his Vakalatnama. He submitted that, Petitioner has filed additional affidavit in support of Petition claiming substantive reliefs.

We have perused the said affidavit and the reliefs claimed therein. We are not in agreement with the learned Advocate for the Petitioner that, substantive reliefs can be claimed by way of additional affidavit. Perusal of main Petition indicates that it is not happily worded and the reliefs claimed in the additional affidavit have not been prayed for in the main Petition.

In view of the above, Mr. Sarda, learned Advocate for Petitioner seeks leave to withdraw present Petition with liberty to file a fresh Petition incorporating all the grounds and necessary reliefs therein. 1/2
