This is an application seeking condonation of delay in filing an appeal challenging the award passed by the Motor Accident Claim Tribunal at Raigad on 23rd June 2016 in MACP No.290 of 2009.

Ms.Deshmukh, the learned counsel for the applicant on instructions seeks leave to withdraw the application and consequently, the appeal as the appellant/insurance company is not desirous of prosecuting the appeal.

In the result, the Civil Application is dismissed as withdrawn.Consequently the registration of the first appeal stands refused.
