By this application, the applicant seeks stay to the execution of the judgment and award dated 3rd October, 2015, passed by Motor Accident Claims Tribunal, Kolhapur, in MACP NO.252 of 201. Learned counsel for applicant undertakes to deposit the entire decreetal amount within two weeks from the date of this order. This statement is accepted as undertaking.

In view thereof, stay is granted to the execution of the impugned judgment subject to condition that applicant deposits the entire amount as awarded by the trial Court, within two weeks from today, in the Tribunal. On failure of the applicant to deposit the amount within the 1/2 905 CAF 3173.doc

stipulated period, stay will stand automatically vacated . 4.

On the amount being deposited, it be paid to the respondent as per the order of the trial Court.
