This is an Application under section 438 of Cr.P.C. filed by the aforesaid Applicant apprehending his arrest in C.R.No.64/2023 registered with Devrukh Police Station, Ratnagiri for offences punishable under sections 354, 354-A and 506 of the Indian Penal Code.

The facts narrated in the FIR prima facie reveal that the Applicant and the first informant, who is a married lady were in amorous relationship. They were exchanging whatsapp messages as well as their photographs. It appears that the husband of the first informant learnt about their relationship. The Applicant herein had lodged FIR against the relatives of the husband of the first informant for assaulting 1/3

him and attempting to cause his death pursuant to which C.R.No.61/2023 has been registered against them. It is only after registration of the said crime, the present C.R.No.64/2023 came to be registered against the Applicant.

The nature of the accusations does not justify custodial interrogation. Hence, the Application is allowed on the following terms and conditions :- (a) In the event of arrest of the Applicant in C.R.No.64/2023 registered with Devrukh Police Station, Ratnagiri, he shall be released on bail on furnishing bail bonds in the sum of Rs.25,000/- with one or two sureties in the like amount ;

(b) The Applicant shall report to the Investigating Officer on 14/06/2023 and 15/06/2023 between 11:00 a.m. to 02:00 p.m.

(c) The Applicant shall not interfere with the complainant and the other witnesses and shall not tamper with the evidence or attempt to influence or contact the complainant, 2/3

witnesses or any person concerned with the case in any manner ;

(d) The Applicant shall keep the Investigating Officer informed of his current address and mobile contact numbers, and/or change of residence or mobile details, if any, from time to time.

The Application stands disposed of.
