1] It is pointed out by learned counsel for the Applicant-Appellant that the appeal was preferred against the order dated 20th February 2016 passed by the City Civil Court Mumbai thereby allowing the unregistered Notice of Motion in terms of prayer clause (a). 2] It is also submitted that now the suit is fixed for recording of evidence.

3] Considering that the order is of the year 2016 and the suit is also fixed for recording of evidence, no purpose is going to serve by keeping this appeal and allowing the application for condonation of delay. 4] Hence, the Appeal along with Civil Application stand disposed of as dismissed.
