DATE : 14th JULY, 2021 (THROUGH VIDEO CONFERENCE) P.C:- Our attention is invited to the order dated 8th July, 2021 passed by the State Government thereby rejecting the proposal submitted by the petitioner for the academic year 2021-2022 to establish the BBA College at Pune.

We are informed by the learned counsel for the parties that the respondent no.2 University has though forwarded its final recommendation in favour of the respondent no.3 to the State

KVM 2/2 29 - WP 2468 OF 2021.doc Government to establish BBA College in Pune, the State Government has not taken any decision thereon till date. 3.

Mr.Mali, learned A.G.P. for the respondent no.1 on instruction states that the issue of issuing final approval to the respondent no.3 is pending and may be issued any time before 31st August, 2021. Statement is accepted.

If any final approval is granted by the State Government in favour of the respondent no.3 to establish BBA College at Pune, the same shall not be implemented for a period of one week from the date of such approval.

Mr.Shah, learned counsel for the petitioner seeks liberty to withdraw this writ petition with liberty to challenge the order dated 8th July, 2021 passed by the State Government and final approval as and when granted by the respondent no.1 in favour of the respondent no.3 to establish BBA College at Pune and also LOI in favour of the respondent no.3.

Writ petition is dismissed as withdrawn with liberty as prayed. No order as to costs.
