1. By order dated 5 th October, 2016 after hearing the parties this Court passed the following order:- "5(a) Petitioner is directed to clear arrears of maintenance charges upto October 2016 on or before 18 th November, 2016 failing which writ petition shall stands dismiss without further reference to the Court."

2. Today, the learned counsel for the petitioner states that the arrears as directed has not been paid. She has instructions to state that the petitioner is not in a position to pay the arrears.

3. By virtue of paragraph 5(a) of the order referred to above, if the amount of arrears is not deposited on or before 18 th November, 2016 the petition stands dismissed without further reference to the Court. Accordingly, petition is disposed of in view of the above terms. (A. K. MENON, J.)
