Heard learned counsel for the applicant and learned APP.

This is an application for bail in respect of offence punishable under section 302 of the Indian Penal Code registered with Vashi Police Station in connection with C.R. No. 0234 of 2019.

It is submitted that in respect of the incident which happened on 11/07/2019, the applicant was arrested on 14/07/2019. He is in custody for almost 3 years and 5

54. ba 2227.21.doc months. Charge-sheet has been filed. Learned counsel submits that the applicant was arrested on suspicion. It is further submitted that trial is not likely to conclude any time soon.

Considering that the applicant is in custody for almost 3 years and 5 months, the trial Court may consider the request of the applicant to expedite the trial if such a request is made by the applicant. In case, the trial does not substantially proceed for 1 year, liberty to move a fresh bail application.
