This is an application for modification of order dated 19th July 2017 passed by this Court in Criminal Bail Application No.1461 of 2017.

While granting bail to the applicant in connection with CR No.9 of 2017, the applicant was directed to report Byculla Police Station once in a week till filing of charge sheet and thereafter once in a month.

Learned advocate for applicant submitted that the applicant has been complying the condition of reporting since 2017. The trial has not commenced. The applicant has been discharged for the offence u/s 376 of IPC and the case ha been relegated to the Court of Magistrate.

Learned APP submitted that reporting once in a month is not harsh condition and the applicant shall comply the said direction. 5.

Considering the fact that applicant has been reporting Byculla Police Station since 2017, relaxation can be granted to the applicant. Hence, I pass following order :

ORDER

(i) The order dated 19th July 2017 passed in Criminal Bail Application no.1461 of 2017 is modified to the extent that the applicant shall report Byculla Police Station, Mumbai once in three months on first Saturday of the month between 11 am and 1 pm till further orders;

(ii) Interim Application is disposed of.
