Heard learned Advocate for the Applicant and learned APP for the Respondent-State.

The Investigating Officer is present. Papers filed along with Application are perused by me. It indicates that the first informant and the Applicant were in love. The WhatsApp messages are there. The relevant messages are on pages 35 to 39. Whereas there photographs are filed on pages 54 to 60 which indicate that both have travelled and they were close to each other. Furthermore, the messages on pages 64 and 65 sent by the first informant to the Applicant suggest that she was in need of finance. There is a cheque 1/3

for Rs.16,000/- issued by the first informant in favour of the Applicant towards repayment and that got dishonoured on 24th March 2023.

Whereas FIR is lodged on 2nd April 2023, by the first informant with Manikpur police station, under sections 354, 354-A, 354-D and 509 of IPC.

The Applicant has made out a case for anticipatory bail and his custodial interrogation is not required, considering the facts and circumstances of the case.

Learned APP submitted that the Applicant is threatening the first informant and even he has threatened that he will make crime patrol story on the basis of allegations in the FIR. The Applicant can be put to certain conditions. In view of that the following order is passed :

ORDER

(a) In the event of arrest, in connection with C.R. No.124 of 2023 registered with Manikpur police station,the Applicant be released on bail on furnishing personal bond and surety bond of Rs.25,000/- for the offences punishable under sections 354, 354-A, 354-D, 509 of IPC.

(b) The Applicant shall not threaten the first informant in any manner.

(c) The Applicant shall give attendance to the Manikpur police station on every first and third Saturday from 10 am to 12 noon.

(d) The Applicant is directed not to publish any news or article depending upon the allegations in the FIR.

(e) The conditions to be operative till filing of the charge sheet.

(f) Needless to say, violating of any conditions above will make the Applicant liable for cancellation of anticipatory bail, after notice to the Applicant.

Application is disposed of accordingly.

These are my prima facie observations. Let the trial Court need not be influenced by them.
