The Applicant has filed this Application under section 438 of Cr.P.C. apprehending his arrest in C.R.No.40/2022 registered with Indapur Police Station, Dist. Pune Rural for offences punishable under sections 403, 408, 409, 420 r/w. 120-B of the Indian Penal Code, 1/3

sections 5 and 6 of The Prize Chits and Money Circulation Schemes (Banning) Act, 1978 and sections 21, 22, 23 and 25 of The Banning of Unregulated Deposit Schemes Act, 2019.

The case of the prosecution is that the Applicant along with the other co-accused had approached the office of the Complainant and had informed the Complainant about a scheme "Bhishi Chalak". The Applicant and the other co-accused lured the Complainant and the others to deposit money in the said scheme. It is stated that the Applicant and the others misappropriated the money deposited by the Complainant and others. The Applicant is alleged to have misappropriated an amount of over 09 lakhs. Pursuant to the orders dated 15/09/2022 and 03/10/2022, the Applicant has deposited before this Court an amount of Rs.10,00,000/-. 3.

The Applicant is on interim bail since long. Considering the nature of the accusations, presence of the Applicant is not required for the purpose of custodial interrogation. Hence, the Application is allowed on the following terms and conditions :- (a) In the event of arrest of the Applicant in 2/3

C.R.No.40/2022 registered with Indapur Police Station, Dist. Pune Rural, he shall be released on bail on furnishing bail bonds in the sum of Rs.25,000/- with one or two sureties in the like amount ;

(b) The Applicant shall report to the Investigating Officer for three days from 05/12/2022 between 11:00 a.m. to 02:00 p.m. ;

(c) The Applicant shall keep the Investigating Officer informed of his current address and mobile contact numbers, and/or change of residence or mobile details, if any, from time to time.
