Heard learned Counsel for the parties.

By this application, the Applicant seeks modification of the condition set out in clause 2 of para 04 of the order dated 5th April, 2018, passed by the learned Additional Sessions Judge-1, Thane, in Criminal Bail Application No.774 of 2018.

The condition of which modification is sought, reads thus:- "04.

The applicant/accused-Mr.Yogendra Vishnu Bhangale be released on bail on executing his P.R. and S.B. of Rs.25,000/- with one solvent surety in like amount ...."

Learned Counsel for the applicant submits that although the applicant was enlarged on bail vide order dated 5th April, 2018, he is, still in custody, as he is unable to furnish the surety, as directed by the learned Additional Sessions Judge-1, Thane. He prays that the applicant be permitted to be released on bail on furnishing two sureties in like amount, to make up the amount of Rs.25,000/-.

Learned APP has no objection if the said condition is modified.

For the reasons set out in the application, the application is allowed and the condition set out in clause 2 of para 04 of the order dated

3/3 5th April, 2018, passed by the learned Additional Sessions Judge-1, Thane, in Criminal Bail Application No.774 of 2018, stands modified. 7.

Accordingly, the Applicant shall now be released on bail on executing his P.R. and S.B. of Rs.25,000/- with two sureties, to make up the amount of Rs.25,000/-. Rest of the conditions imposed vide order dated 5th April, 2018, to remain as it is.

The Application is allowed and disposed of in above terms. 9.
