Since an Appeal under Section 7-I of the Employees' Provident Fund Act & Misc. Provisions Act, 1952 is available, the above Writ Petition challenging the order passed under Section 14B of the Employees' Provident Fund Act & Misc. Provisions Act, 1952 need not be entertained by this Court. By relegating the Petitioner to the said remedy, the above Writ Petition is disposed of.

Needless to state that the contentions of the Petitioner has not been dealt with and it is before the Appellate Authority that the said contentions can be urged by the Petitioner.

If the issue of limitation arises, the fact that the Petitioner was prosecuting the instant Petition can be urged by the Petitioner. [R.M.SAVANT, J] BGP.
