Learned counsel for the petitioner submits that he has received instructions from the petitioner that in this crime, the police has filed "B"-Summary Report before the concerned Court. If that is so, we are of the view that this petition has been rendered infructuous in view of filing of "B"-Summary Report by the concerned Court. As such the petition deserves to be dismissed with appropriate liberty to the petitioner. Accordingly, the petition stands dismissed, with liberty to the petitioner to appear before the concerned Court and oppose the acceptance of the "B"-Summary Report, if so advised, keeping all questions open.
