The learned Counsel for the applicant states that he has not raised any statutory defence and that the notice to respondent no.4 can be dispensed with. In the light of the said statement, notice to respondent no.4 is dispensed with.

By this application the applicant has sought to condone the delay of 150 days in filing appeal against the judgment and award dated 10th August, 2016 in MACP No.935 of 2012 passed by the pps

The learned Counsel for the respondent nos.1 to 3 has no objection to condone the delay. In view of the no objection given by the learned Counsel for the respondent nos.1to 3, as well as considering the reasons stated in para 4 of the application, the delay in filing the appeal is condoned.
