Pursuant to the praecipe filed by the learned counsel for the Appellant, the matter is taken on production board.

The learned counsel for the Appellant submits that this Hon'ble Court be pleased to extend further four weeks'

time to comply with order dated 03.6.2019 i.e. to file private paper book.

She submits that it remained on their part to comply with the said order within stipulated time.

On the other hand, the learned counsel for the Respondent No.1 has vehemently opposed the prayer. He submits that the first order was passed Basavraj G. Patil 1/2

501.1075.15-fa.odt on 05.07.2017 directing the Appellant to file private paper book and thereafter time was extended.

Considering the submissions made by the learned counsel for the Appellant and the earlier order, following order is passed:

a.

The Appellant is permitted to file private paper book on or before 30.09.2019, with copy to other side.

b.

The Appellant shall pay cost of Rs.5000/- to the Respondent or their Advocate on or before 23.08.2019 and place on record a receipt thereof, failing which the First Appeal shall stand dismissed without further reference to the court.
