Learned Counsel for the petitioner seeks leave to withdraw the aforesaid petition, when the learned Counsel for the respondent No.2 pointed out to this Court, that the very same applicant had earlier filed an application before this Court being Criminal Application No. 1518 of 2019 seeking the same reliefs, and that, this Court had disposed of the said petition as withdrawn vide order dated 3rd February, 2020.

Considering the aforesaid, present petition stands disposed of.

In view of the aforesaid, the interim relief stands vacated. Needless to state, that it is open for the petitioner to file an application seeking his discharge from the case before the Trial Court, in the event, charge has not been framed till date. 4.
We make it clear that we have not gone into the merits of the petition and as such, all contentions of all parties are kept open. S. M. MODAK, J.
