Heard learned counsel for the applicant. Learned counsel for the applicant submits that he is in custody almost for 3 years and 1 month in respect the alleged offence under section 376(a)(b) of the Indian Penal Code and under sections 4, 6, 8 and 12 of the Protection of Children from Sexual Offences Act, 2012. Learned counsel for the applicant requested trial to be expedited in view of the incarceration of 3 years and 1 month. Learned counsel seeks liberty to withdraw the application.

Considering the period the applicant has been in custody, trial Court is requested to expedite the trial and preferably within 9 months from today. In case, the trial does not proceed for some reason, liberty to apply afresh for bail.

It is clarified that the learned counsel for the applicant has not argued the matter on merits. 4.

The bail application is allowed to be withdrawn and disposed of.
